Important Documents and Definitions

It is important that Housing Agencies, families and landlords familiarize themselves with some very important documents pertaining to the HCV Program. Below are the top 6 documents that are used in the program. They outline the rules, policies and procedures that are vital to the Program.

  • The contract between HUD and the local PHA.
  • The PHA agrees to administer the HCV Program in accordance with HUD regulations and requirements.
  • HUD Agrees to make payments to the PHA to fund HCV Program.
  • Defines PHA obligations and outlines remedies for reaches of contract.

  • The PHAs principal statement of written policies. Includes requirements, processes and local guidelines.
  • Prevents misunderstanding, avoids lawsuits and creates consistency in decision making.
  • Must be adopted by PHA board (including all revisions).
  • Although not approved by HUD, it is required and must be made available for auditing purposes. 
  • Provides daily guidance to staff on how to perform the necessary functions of the HCV Program.
  • The form that gives family’s authorization from the PHA to search for housing under the HCV Program.
  • It provides evidence that the PHA has determined the family to be eligible to receive rental assistance subsidy.
  • Specifies the subsidy size (based on unit size) for which the family qualifies for.
  • Contains a brief description of how the program works and explains the family obligations under the program.

  • With the submission and signature, this form says to the agency that the owner has screened the participant and has been determined to be approved as a renter by the owner.
  • This form says to the agency that the family has selected the unit and has determined the unit to be selected by the tenant.
  • Once submitted the agency will begin the process of determining affordability for the tenant, determining if the unit and rent can be approved
  • Once submitted the agency will begin the screening of the owner for approval.

  • The contract between the landlord and the participant.
  • It is a legal and binding document and can be used by the court in the event of legal proceedings.
  • Outlines and details the obligations and responsibilities of the landlord and the tenant
  • Defines the agreed upon length of lease, monthly rental amount, and who will be responsible for upkeep of the property.
  • A contract between the PHA and the Landlord
  • Outlines the obligations of the PHA and the Landlord and the penalties for contract violations
  • Defines the initial PHA housing assistance payment to the owner
